These Terms of Service (“Terms”) govern your use of the Seek for Consumer and Seek Biz mobile applications and related services (together, “Seek”). By creating an account or using Seek, you agree to these Terms. If you do not agree, please do not use Seek.
Seek is operated by Mithiin Software Development Services, a sole proprietorship registered with the Philippine DTI (Business Name Reg. No. NCYL671719248596) (“Mithiin”, “we”, “us”), based in Davao City, Philippines.
You must be at least 18 years old to use Seek. By using Seek, you confirm that you are 18 or older and able to enter into a binding agreement.
You sign in using Google (Android and iOS) or Apple (iOS). You are responsible for the activity under your account and for keeping access to your sign-in method secure. The information on your account must be accurate. We may suspend or terminate accounts that violate these Terms.
Seek is a discovery and engagement platform that helps consumers find local businesses and lets businesses publish listings and run loyalty features. Seek is an intermediary only.
Seek does not handle transactions or money. We do not sell products or services, do not process payments, and do not hold or transfer funds. Any purchase, booking, payment, reward, or other dealing happens directly between you and the business. Seek is not a party to, and is not responsible for, those dealings.
Loyalty stamps, badges, rewards, products, and promotions shown in Seek are created, offered, and honored by the businesses themselves, not by Seek. We provide the tools, but we do not guarantee that any reward or promotion will be available or honored, and we are not responsible if a business changes or fails to fulfill one. When you redeem a loyalty stamp with a business, that business will be able to see your name as part of the redemption (see our Privacy Policy).
If you list a business on Seek Biz, you represent that you are authorized to do so and that the information you provide is accurate and lawful. You are solely responsible for your listing’s content, including photos, descriptions, hours, and promotions. You grant Mithiin a non-exclusive, royalty-free license to host, display, and distribute that content within Seek for the purpose of operating the service. You must keep your listing accurate and must not list a business you do not own or are not authorized to manage.

You retain ownership of the content you submit. You are responsible for ensuring you have the rights to any content (including photos) you upload, and that it does not violate any law or third-party right. We may remove content that we reasonably believe violates these Terms or the law.
Seek, including its software, design, branding, and the “Seek” and “Mithiin” names and logos, is owned by Mithiin and protected by law. These Terms do not grant you any right to use our branding without our prior written permission.
Seek is provided on an “as is” and “as available” basis. We do not guarantee that listings, business details, hours, promotions, or other information are accurate, complete, or current — much of it is provided by businesses. Listing a business on Seek is not an endorsement. We do not guarantee that the service will be uninterrupted or error-free.
To the maximum extent permitted by law, Mithiin will not be liable for any indirect, incidental, or consequential damages, or for any dealings between you and a business, any reward or promotion not honored, or any inaccuracy in listings. Nothing in these Terms limits any liability that cannot be limited under Philippine law.
You may stop using Seek and delete your account at any time from within the app. We may suspend or terminate your access if you breach these Terms or the law, or to protect the service or other users. You can request deletion of your personal data as described in our Privacy Policy.
We may update Seek and these Terms from time to time. When we make material changes to these Terms, we will update the “Last updated” date above and, where appropriate, notify you in the app. Continued use after an update means you accept the revised Terms.
These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these Terms or your use of Seek shall be subject to the exclusive jurisdiction of the proper courts of Davao City, Philippines, without prejudice to any mandatory consumer-protection venue rules that may apply.
